Finance ministry said there was growth of 19 per cent in income-tax returns electronically filed for the A.Y.  2018-19 compared to those in 2017-18.The ministry said a total of 66.8 million returns were e-filed in FY19, which included 64.9 million for AY19. On the other hand, a total 67.4 million returns were e-filed in 2017-18 (FY18), which included 54.7 million for AY18.

CBDT said that every CIT has to file 10 prosecution cases for default in the filing of return of income. Considering the Rs 60,000 crore shortfall in direct tax collection in the last fiscal.
CBDT wants all IT commissioners to ensure that each AO disposes off at least 25 domestic cases or 20 international cases during the three-month period.

🔑Key highlights on DPT3

1.      Form DPT-3 is exempted for Government Companies and NBFC Companies.

2.      NIL RETURN IS ALSO COMPULSORY

3.      Audit of Financials for FY 2018-19 is not compulsory for filing Form DPT-3

4.      As per Rule 16 Figures filled in Form DPT-3 should be audited one for that Auditor Certificate may be obtained

5.      Difference between One time Return and Annual Return.

a.      In One time Return we need to fill the amount received after 01/04/2014 and outstanding on 31/03/2019 but in Annual return, date of receipt of amount is not important, it covers every amount outstanding on 31/03/2019 whether received on or before 01/04/2014.

b.      In One time return only amount outstanding is required to be filled, no detail for that amount is required but in annual return detail for the outstanding amount is required to be filled.

c.      It is mandatory to bifurcate the amount of Deposit and amount exempted from Deposit in annual return, but in One time return no such bifurcation is required. 

d.      One time return is need to be filed on or before 29th June, 2019 and annual return on or before 30th June

6.      Object clause in form will be pre-filled from last AOC-4 or in case change in object activity from latest MGT-14 filed, So please check the same before filing form if there is any difference then raise Query on MCA.

7.      In point 8 of Form DPT-3, Net Worth should be calculated as per preceding audited statement for this time it will be Audited financial statement for the year ended on 31.03.2018.

8.      Net Worth as per Form DPT-3 considers intangible assets but as per definition of Net Worth, Net Worth does not consider intangible assets, so there are chances that Net Worth filled in Form AOC-4 and in Form DPT-3 could be different, So Advisable to attach Clarification on that.

9.      Auditor Certificate is not Compulsory but advisable to comply the words of Rule 16 even in case of NIL Return.

a.      Intercorporate Deposit is Exempted one but Loan from LLP is not Exempted one it is Deposit.

RULING Return of galvanised goods to applicant satisfies  the condition of receiving back the inputs. DPT3 Highlights

• DPT-3 has to be filed twice

• 1st DPT-3 for amounts which are NOT deposits (exempted deposits) outstanding as on 31.3.2019 AND received on or after 1.4.2014 by 29th June 2019 where Auditor's Report is NOT mandatory.

• 2nd DPT-3  for amounts which are deposits as well as amounts which are not deposits (exempted deposits) outstanding as on 31.3.2019 by 30th June 2019 where Auditor's Report is mandatory. This would include any amount received prior to 1.4.2014 and outstanding as on 31.3.2019. This is an annual report, which is to be complied every year.

• ICAI is in process to announce the draft Auditor Report for this purpose.

• ADT-1 / GNL 2 issue regarding appointment of auditors is being worked upon by MCA and should be sorted out very soon.

CBDT released data that after clocking steep growth of 25% in the three years to FY18), the number of taxpayers filing income-tax e-returns saw a marginal contraction in FY19. In FY19, only 6.68 crore returns were filed online, 1% lower than 6.74 crore filed in FY18.

Income tax department has released the software utility in excel format for filing ITR2 for FY2018-19. It is to be used by individuals having capital gains or more than one house property but not by those individuals having income from business and profession.

Bombay High Court in the matter of Pr. CIT Vs State Bank of India Stated that Interest on Income Tax Refund cannot be denied for Mistake committed by assessee during ITR filings.

GSTR-9 is merely a compilation of data filed in GSTR-3B and GSTR-1. As per the instructions of the form GSTR-9, it is stated that information of outward supplies ‘may’ be derived from Form GSTR 1. 👉RBI increases the Eligibility Cap on Home Loans extended by Regional Rural Banks (RRBs)and Small Finance Banks (SFBs) to ₹35 lakh in Metropolitan Areas and ₹25 lakh in Other Centres, provided the overall cost of the dwelling unit in the metropolitan centres and other centres does not exceed ₹45 lakh and ₹30 lakh, respectively. All such loans will be now classified by these banks as Priority Sector Loans.

MCA has notified the Companies (Acceptance of Deposits) Second Amendment Rules, 2019 which shall come into force on the date of their publication in the Official Gazette i.e 30-04-2019. A welcome step by MCA by replacing 31-03-2019 for the words "the date of publication of this notification in the Official Gazette". Stakeholders are now required to capture the data in the Form DPT – 3 upto the date of 31-03-2019 instead of 22-01-2019, as notified earlier. Further, the form is also required to be filed with in 90 days of 31-03-2019 which means the stakeholders have time to file the said Form upto 29-06-2019 instead of earlier notified date of 30-05-2019.

 
MCA has notified the Companies (Appointment and Qualification of Directors) Amendment Rules, 2019 which shall come into force on the date of their publication in the Official Gazette i.e 30-04-2019. Amendments to Rule 12A are made to extend the time limit prescribed for submission of Form DIR – 3KYC by every director having approved DIN. The form DIR – 3KYC is now also required to be filed upto 30-06-2019 instead of earlier notified date of 30-04-2019. Further, the said Form DIR – 3KYC is yet to be made available on the portal of MCA.

The Institute of Chartered Accountants of India has been continuously evolving ways to automate and re-engineer processes in order to make transactions easier and user friendly.

One such step has been the creation of SSP (Self Service Portal), an initiative from ICAI to make applications (Forms) and transactions (Services) - faster and easier.

The full scale Student and Member / Firm Services by ICAI will be put to implementation starting third week of May 2019.

ICAI has scheduled a one-time migration activity from old system to new system from 6th May 2019. The entire IT Systems (including e-services) with respect to Members and Student Services will not be available between 6th May to 22nd May 2019 and the Regional Offices will not be able to process any form or any other transaction. However the membership renewal link will be available and Members will be able to make fee payments through online mode. However New Students of Foundation Course and Direct Entry will also be able to register.

Very Important : As entire ICAI is moving towards new Digital platform, PHYSICAL DAK including CHEQUES / DD’s will not be accepted by Regional Offices and Branches beyond 6th May 2019.

Please note that effective 22nd May, 2019 (Wednesday), ICAI will accept only Online Application forms only through e-services at the link

Bombay High Court & ITAT ruled out that the transfer of a subsidiary’s share cannot be ‘slump sale’ of an undertaking. The court and tribunal rulings could deter income tax officials from branding every large equity transaction as a slump sale of a business to a third party and levy capital gains tax under section 50B of the Income Tax Act.

CBIC has clarified vide its Circular, that IGST Credit will be first used to offset IGST Liability and thereafter it can be used to offset CGST and SGST/UGST liability in any order and in any proportion as per newly inserted Rule 88A of the CGST Rules vide Notification No. 16/2019-Central Tax dated 29th March, 2019.

GST officers are working on a system where businesses above a certain turnover threshold will have to generate 'e-invoice' on government or GST portal for every sale, thereby effectively reducing the room for tax evasion. To start with, businesses above a specified threshold will just get a unique number for every electronic invoice or e-invoice generated.

eForm MSME (Form for furnishing half yearly return with the registrar in respect of outstanding payments to Micro or Small Enterprises) is available on MCA21 Company Forms Download page w.e.f 1st May 2019.

Government's initiatives such as relaxed norms for company incorporation, and removing requirement of a bank account for GST registration will help India further improve its ease of doing business ranking of the World Bank this year.

Central Economic Intelligence Bureau (CEIB) is of the view that use of the stringent Prevention of Money Laundering Act could be considered to curb and deter fraudulent input credit tax, claimed by companies generating fake invoices of GST. till December 2018, input tax credit was fraudulently availed by creating fake GST invoices to the tune of Rs 4,000 crore.

👉GST Officers are working out a mechanism to deal with Non-Payment of Taxes by large number of Small Restaurants and Retail Entities which are collecting taxes from customers but not depositing with the Govt. Several consumers have filed complaints through a mobile app—Iris Peridot—that GST was charged by small restaurants but the eatery neither deposited taxes with the Govt.  nor filed GST returns.

👉The Govt is soon likely to invite select lenders for discussion on a Second Round of merger in Public Sector Banks. The lenders to be called may include Punjab National Bank (PNB), Union Bank of India and Bank of India (BoI).

👉In light of recent defaults by various companies on their debt papers, to which several Mutual Funds had Sizeable Exposure, the SEBI is likely to revisit regulations relating to Mutual Funds to Safeguard Investor Interests. The move comes after recent defaults in various Fixed Maturity Plans (FMPs) by several mutual funds.

👉India hikes Import Duty on Wheat to 40% from 30% to support local farmers. The hike in duty is likely to make imports of wheat unviable for flour mills even after recent declines in global prices.

👉Amid uncertainty over India's Oil Import Possibilities from Iran after the waivers to US sanctions on Iran are withdrawn, IDBI Bank has stepped-up efforts in this direction by creating Iran Trade Processing Cells in 3 Indian cities. IDBI received the approval to handle Import-Export Transactions with Iran in early March.

👉More than 50 Property Developers, including some of India’s Top Builders, are being investigated for profiteering under the GST Regime. The investigation by the Directorate General of Anti-Profiteering (DGAP) is trying to find out if the Builders made undue profits by failing to pass on to buyers the benefit of Input Tax Credit that was available to them.

👉In a move to tackle fund diversion, RBI proposes sterner rules on opening and running of Current Accounts of Corporate Borrowers. Current accounts, according to a Draft Circular shared by the RBI with the banking industry, can “only be opened” with the lead bank in a Lending Consortium while other banks having Collection Accounts will have to transfer funds at the end of the day to the current account with the consortium leader.
