๐Ÿ‘‰ No prosecution could be launched against assessee on mere failure to pay self-assessment tax: Kerala HC

Forzza Projects (P.) Ltd. v. PCIT

Assessee filed a return of income, but the tax was not remitted. Subsequently, the tax was remitted with interest by availing instalment facility. AO initiated prosecution under Section 276C. Assessee contended that there was only a failure to make payment of tax in time. It will not fall under a willful attempt to evade any tax. Hence, the criminal liability under Section 276C couldn’t be fastened.

High Court explained that there was no concealment of any income. What is involved is only a failure to pay the tax in time, which was later paid after availing installment facility with interest. A mere failure to pay the amount due (tax, interest, or penalty) will not satisfy the requirement that constitutes the offence under section 276C.

⚫The Govt announced a string of measures, including a pension for dependents of those having lost their lives due to COVID-19, among other benefits for the families who lost their earning members to the pandemic.This benefit will be available retrospectively with effect from March 24 last year and for all such cases till March 24, 2022.
⚫The Govt announced a number of welfare measures for children who lost their parents to COVID-19, including ensuring a corpus of Rs 10 lakh when they turn 18 and providing for their education.
⚫Underlining that public health and hospitals are "state subject", the Aurangabad Bench of the Bombay High Court on Friday said the state govt is answerable for issues related to public health and hospitals.
⚫Petrol price crossed the Rs 100/litre mark in Mumbai after the 15th increase in fuel prices this month. Petrol price was increased by 26p/l and diesel by 28p/l.
⚫Flights within the country are set to become costlier as the Ministry of Civil Aviation has decided to raise the lower limit on domestic airfares from 13-16% which will come into effect from June 1.
⚫The Delhi Govt has extended the COVID curfew for another week till 5 am of June 7 while allowing operations of mfg/production units within closed premises.
⚫ Kerala, Tamil Nadu, Maharashtra and Goa have extended the COVID-induced lockdown or other restrictions for a week to a fortnight from Monday.

CARO 2020 is a new format for issue of audit reports in case of statutory audits of companies under Companies Act, 2013. CARO 2020 has included additional reporting requirements after consultations with the National Financial Reporting Authority (NFRA) (01.10.2018). NFRA is an independent regulatory body for regulating the audit and accounting profession in India. The aim of CARO 2020 is to enhance the overall quality of reporting by the company auditors.

The revised CARO requires far more details as compared to old CARO whereby there are 21 clauses out of which 7 new clauses have been introduced and various existing clauses have been amended whereby new details are required. Considering the amount of records to be verified and certifications to be done by the auditor, it would be not wrong to say that the auditor is no longer just a watchdog but will have to be a blood hound. The amendments will require the auditor to be in an investigative mode and dig out as much information as they can from the records available.

Various amendments have been made in CARO such as requiring the auditor to report on Revaluation of PPE, Benami Transactions, Fraudulent Transactions, Diversion of funds, Wilful Defaulter, Whistle Blower Complaints, Quarterly statements submitted to financial institutions, Undisclosed Income, Cash Loses, Internal Audit Systems, Resignation of auditors, Solvency of the company and CSR reporting.

Amnesty Scheme to provide relief to taxpayers regarding late fee for pending returns:
To provide relief to the taxpayers, late fee for non-furnishing FORM GSTR- 3B for the tax periods from July, 2017 to April, 2021 has been reduced / waived as under: -
i. late fee capped to a maximum of Rs 500/- (Rs. 250/- each for CGST & SGST) per return for taxpayers, who did not have any tax liability for the said tax periods;
ii. late fee capped to a maximum of Rs 1000/- (Rs. 500/- each for CGST & SGST) per return for other taxpayers;
The reduced rate of late fee would apply if GSTR-3B returns for these tax periods are furnished between 01.06.2021 to 31.08.2021.

⚫The Pension Fund Regulatory Development Authority announced that  AUM under NPS and Atal Pension Yojana have crossed the Rs 6-trillion mark.

๐Ÿ“š Supply of medicines ๐Ÿ’Šand allied items ๐Ÿ’‰ provided by the hospital ๐Ÿฅ through the pharmacy to the in-patients๐Ÿ‘จ and out-patients ๐Ÿšน. Which is Taxable?

⚖️ M/S. ERNAKULAM MEDICAL CENTRE PVT. LTD.: AAR KERALA

1️⃣ Health care services provided by a clinical establishment, an authorized medical practitioner or para medics are exempted vide Sl.No.74 of Notification No. 12/2017-CT (Rate).

2️⃣ In case of inpatient as well as out patient, medicines are dispensed based on prescriptions. There is no privilege for the hospitals that are dispensing medicine to outpatients. Pharmacy run by hospital dispensing medicine to outpatient or bye standers or others can be treated as individual supply of medicine and not covered under the ambit of health care services. Hence such supply of medicines and allied goods are taxable.

3️⃣ Clarifications issued on the 25th GST Council meeting,  was clarified that food supplied to the inpatients as advised by the doctor/nutritionist is a part of composite supply of health care and not separately taxable. Other supplies of food by hospital to patients not admitted are taxable. The same principle is applicable in the case of dispensing of medicines also.

4️⃣ *Ruling:*- The supply of medicines and allied items provided by the hospital through the pharmacy to the in-patients is part of composite supply of health care treatment and hence not separately taxable. However, The supply of medicines and allied items provided by the hospital through the pharmacy to the out-patients is taxable.

CBDT issues clarification wrt limitation for filing of appeals before CIT(Appeals) under Income-tax Act,1961 in consonance with directions issued by Hon'ble Supreme Court in Suo Motu WP(Civil) No 3 of 2020 vide order dt 27th Apr, 2021. Circular No 10 of 2021 dt 25.05.2021 issued.

Central Board of Direct Taxes has notified a new rule for computation of fair market value of capital assets in slump sale. As per the amendment made to the income tax rules, the new Rule 11UAE under section 50B has given two formulae for calculation and has stated that the fair market value will be the higher among the two values.

Centre will appeal against the Delhi High Court decision striking down the reduced integrated goods and services tax (IGST) levied on oxygen concentrators received as a gift from outside India by individuals, said a senior government official. The court called the levy unconstitutional.

Stock brokers’ association Anmi has urged the markets regulator, Sebi to reconsider the proposed 100 per cent levy on intra-day trade peak margins, as the higher-margin will reduce hedging opportunities. In a letter to Sebi on May 15, the Anmi said there is a great disconnect between what is being collected from clients and what needs to be collected vis-a-vis the attendant risks arising in intraday trades.

DHC : E-Pass not mandatory for Advocates during curfew period.

Single Judge Bench comprising of Justice Suresh Kait has disposed of a petition praying for respondent Delhi Police to comply with the curfew order dated 19.04.2021 which has exempted Advocates from producing E-pass for travelling during the curfew period.

The present petition was filed by Advocate Dharmendra Kumar who has claimed in the petition that he was harassed by the respondent because he did not possess an E-pass while travelling during the curfew. According to the curfew order dated 19.04.2021 advocates are exempted from possessing such pass for travelling during the curfew period. 

The argument of the respondent Delhi Police was that the petitioner was not harassed and that he was let go once he had produced a I Card. 

The Court held that the authorities cannot stop anyone who can produce a valid ID proving that he is an advocate. 

The court further held that the present order must be communicated to commissioner of police who shall communicate the same to the DCP who shall in-turn communicate to all police officers.

๐Ÿšฃ๐Ÿผ‍♂️ New taxpayer friendly portal integrated with immediate processing of Income Tax Returns(ITRs) to issue quick refunds to taxpayers;

๐Ÿคน๐Ÿป‍♀️ All interactions and uploads or pending actions will be displayed on a single dashboard for follow-up action by taxpayer;

๐Ÿช” Free of cost ITR preparation software available online and offline with interactive questions to help taxpayers fill ITR even without any tax knowledge, with pre-filling, for minimizing data entry effort;

☎️ New call center for taxpayer assistance for immediate answers to taxpayer queries with FAQs, Tutorials, Videos and chatbot/live agent;

๐Ÿ“ฒ All key portal functions on desktop will be available on Mobile App which will be enabled subsequently for full anytime access on mobile network;

⏳ New online tax payment system on new portal will be enabled subsequently with multiple new payment options using netbanking, UPI, CreditCard and RTGS/NEFT from any account of taxpayer in any bank, for easy payment of taxes.
 
๐Ÿ”ฎ In preparation for this launch and for migration activities, the existing portal of the Department at www.incometaxindiaefiling.gov.in would not be available from1st June, 2021 to 6th June, 2021.

๐Ÿ’Ž In order to avoid any inconvenience to taxpayers, the Department will not fix any compliance dates during this period. 

๐Ÿ’‰ Further, directions have been issued to fix hearing of cases or compliances only from 10th June,2021 onwards, to give taxpayers time to respond on the new system. 

๐Ÿงฒ Taxpayers are encouraged to complete all their urgent tasks involving any submission, upload or downloads before 1stJune, 2021 to avoid any difficulty during the blackout period.

๐Ÿงƒ The Department requests the patience of all taxpayers and other stakeholders during the switchover to the new e-filing portal and the subsequent initial period while they get familiarized with the new system.

The Income Tax Department is going to launch its new e-filing portal on 7th June, 2021. The new e-filing portal is aimed at providing taxpayer convenience and a modern, seamless experience to taxpayers:

All interactions and uploads or pending actions will be displayed on a single dashboard for follow-up action by taxpayer

Free of cost 1TR preparation software available online and offline with interactive questions to help taxpayers fill ITR even without any tax knowledge, with pre-filling, for minimizing data entry effort;

New call center for taxpayer assistance for immediate answers to taxpayer queries with FAQs, Tutorials, Videos and chat box/live agent;

All key portal functions on desktop will be available on Mobile App which will be enabled subsequently for full anytime access on mobile network;

New online tax payment system on new portal will be enabled subsequently with multiple new payment options using net banking, UPI, Credit Card and RTGS/NEFT from any account of taxpayer in any bank, for easy payment of taxes.

In preparation for this launch and for migration activities, the existing portal of the Department at would not be available to taxpayers as well as other external stakeholders for a brief period of 6 days i.e. from 1st June, 2021 to 6th June, 2021.

In order to avoid any inconvenience to taxpayers, the Department will not fix any compliance dates during this period. Further, directions have been issued to fix hearing of cases or compliances only from 10th June, 2021 onwards, to give taxpayers time to respond on the new system. If, any hearing or compliance which requires submissions online has been scheduled during this period, the same will be preponed or adjourned and the work items would be rescheduled after this period.

The Department has also intimated external entities including Banks, MCA, GSTN, DPIIT, CBIC, GeM, DGFT who avail services of PAN verification etc. about the non-availability of the services and to request them to make arrangements to ensure that their customers/stakeholders are apprised, so that any relevant activity can be completed prior to or after the blackout period.
Taxpayers are encouraged to complete all their urgent tasks involving any submission, upload or downloads before 15 June, 2021 to avoid any difficulty during the blackout period.
The Department requests the patience of all taxpayers and other stakeholders during the switch over to the new e-filing portal and the subsequent initial period while they get familiarized with the new system. This is another initiative by CBDT towards providing ease of compliance to its taxpayers and other stakeholders.

⚫The US Govt has removed a regulation proposed by Trump’s administration that sought to narrow the definition of “specialty occupation” under the H-1B visa regime. The change comes as a relief for Indian information technology firms, which are among the largest users of such visas.
⚫The Centre increased its share of subsidy for DAP  by 140% from Rs 500 to Rs 1,200 per bag, thereby rolling back the steep 58% hike in prices announced by co's since April. The Centre would spend an additional Rs 14,775 crore on fertiliser subsidy in the current financial year.
⚫The RBI said full KYC compliant prepaid payment instruments have to offer their holders interoperability through card networks and UPI mandatorily by March 31, 2022. 
⚫The expert group on vaccine administration said that Covid patients can get jabs three months after recovery from illness. If a person catches infection after the first dose of vaccine, the second one has to be taken three months after clinical recovery. 
⚫India witnessed 267334 fresh coronavirus cases and reported a national record of 4,529 new deaths.

3️⃣ E-way bill integrated with FasTag, RFID. GST authorities to get real-time data of commercial vehicles.

4️⃣ Important Change in E-way Bill Rules - Rule 138E, for the words “in respect of a registered person, whether as a supplier or a recipient, who, —” the words „‟in respect of any outward movement of goods of a registered person, who, —” shall be substituted. NN -15/2021.

Submission of your ITR\PAN Copy to Banks to avoid deduction of TDS on Cash Withdrawal upto 1 Crore u/s 194N as follows: -

Rate of TDS if Income Tax Return copy is submitted to bank:
Up to Rs.20 Lakh - Nil
Rs.20 Lakh to Rs.1 Crore - Nil
In excess of Rs.1 Crore - 2%

Rate of TDS if No Income Tax Return copy is submitted to bank:
Up to Rs.20 Lakh - Nil
Rs.20 Lakh to Rs.1 Crore - 2%
In excess of Rs.1 Crore - 5%

It will be applicable for all accounts under your PAN starting from 1.4.2021 based on Primary CRN (Customer Relationship Number) with Bank.

You can submit ITR for any of the earlier 3 years. 

If no PAN is available with Bank than above rate will increase to 20 % + applicable cess & surcharge u/s 206AA.

File GSTR-3B by 20.5.21 to avoid interest. Rule 36(4) not to apply to Apr 3B as 2B will be generated on 29.5.21 due to extension of GSTR-1 till 26.5.21. 

GST Rule-60(7) of CGST Rules-2017 prescribes for generation of auto-drafted statement containing the details of input tax credit in FORM GSTR-2B for counter-party recipients. As per Rule-60(8) of CGST Rules-2017, FORM GSTR-2B shall be made available to the recipients after the Due date of filing GSTR-1/IFF by the suppliers. 

NBFC  lenders have seen a 50% rise in customers missing payments in the first fortnight of May, threatening to push up overall defaults to perilous levels. Most non-bank finance companies (NBFCs) have been forced to stop door-to-door collections after several payment pick-up agents succumbed to the virus in the past six weeks or so.

Does The ICAI really want to extend the benefits of CABF to members?

They are looking for the Members whose Family Income is not more than Rs. 25000/- per month or Rs. 3,00,000/- per annum.

Does anyone know a CA who along with his/her spouse is not able to earn more than Rs. 25K per month, which, means he is not able to earn his livelihood at all along with his/her spouse. Even freelancer accountants earn more than that? Which essentially means that our professional degree can not worth earn even Rs. 25000/- per month as family income.

Or does the motto is just to show that CABF is helping but not to actually help?

Further, even if a CA is found eligible under this category, they want the copy of ITR or Salary slip of last drawn salary...A practicing CA who is not having Salary Slip, is not at all required to file ITR as per Income Tax Act also and accordingly has not filed the same considering his situation will again not be eligible for the help. Even it will be difficult to find a CA in service who is not even earning 25K per month along with his/her family.

So who is getting benefitted out of CABF?

⚫India’s wholesale price based inflation surged to an 11-year high of 10.49% in April, mainly due to a sustained rise in fuel and commodity prices, signalling a build-up of inflationary pressures.
⚫The demand for gem and jewellery is back in major export markets, as the overall shipments surged to Rs 25,226.11 crore yoy in April 2021.
⚫Several co's rush to file DRHP with SEBI.12 co's looking to raise a cumulative Rs 22,230 crore have filed their offer documents so far this month.
⚫Fewer e-way bills have been generated in May so far, with the daily average falling to a one year low, indicating a sharp slowdown in economic activity owing to the intense second wave of Covid-19.This suggests that GST collection for May and June may see a downward trend after touching record levels in April and March.

LTC deadline to submit bills/claims for benefits under the LTC Special Cash package scheme has been further extended to May 31, 2021. The Department of Expenditure, via an Office Memorandum stated that due to the current Covid-19 situation the last date of submission of bills under the LTC Cash scheme has been extended till May 31.

Today (18.5.21) is last date to pay tax for Q4 of 20-21 by GST Composition persons with interest @ 9% pa from 4.5.21. Interest @ 18% pa wef 19.5.21. 

Personal bank accounts of promoters cannot be attached under CGST. Case Name : Roshani Sana Jaiswal Vs Commissioner of Central Taxes (Delhi High Court). Appeal Number : WP(C) No. 2348 of 2021. Date of Judgement/Order : 12/05/2021

CBIC has asked field offices to clear all pending refunds of customs and drawback claims by month-end. The Central Board of Indirect Taxes and Customs has issued an instruction to all customs Principal Chief Commissioners that a 'Special Refund and Drawback Disposal Drive' will be conducted with the objective of priority processing and disposal of all pending refund and drawback claims.

Simultaneous investigation by central and state gst authorities for same period is not allowed in the matter of Anurag Suri Versus The Director General of Goods and Services Tax Intelligence and others (w. P. ( c ) no. 158 of 2020). 

RBI has shot down suggestions of a fresh suspension of the Insolvency & Bankruptcy Code (IBC) due to the second wave of Covid-19, while making it clear that banks can still restructure distressed but viable loans, ensuring that their balance sheets remain transparent. During initial discussions with the government, RBI has indicated a freeze will not help anyone in the long run as it will only show lower level of NPAs.

๐ŸŒท Death of Proprietor- the Procedure for Transfer of Business as Going Concern to Successor- in GST
                                                                                                        
๐Ÿชด 1.  Registration of a New Entity in which business of deceased individual is to be transferred w. e. f. date of succession i.e. date of death of proprietor. If successor is a minor, his legal guardian will be the authorized signatory.

๐ŸŒฑ 2.  Application by legal heir/ successor with Jurisdictional GST Officer for appointment as authorized signatory and issuance of new login id and password. 

๐Ÿ„ 3. The GST Officer will send a temporary user id and password on the email of newly added authorized signatory.

๐ŸŒด 4. The Authorized signatory shall file all monthly GST Returns applicable till the date of succession and pay applicable taxes.

๐Ÿ 5. The authorized signatory shall file Form GST ITC-02, for transfer of ITC lying in the electronic credit ledger, using the registration of deceased proprietor. 

๐ŸŒฒ 6. The New Entity shall accept the details of Form GST ITC-02 and upon such acceptance the unutilized ITC will be transferred to the Electronic Credit Ledger of New Entity.

๐ŸŽ‹ 7. The authorized signatory shall file application for cancellation of registration in Form GST REG 16 for cancellation of registration of deceased proprietor after completing all other compliances till date.

๐ŸŒป 8. After issuance of cancellation order the authorized signatory shall file final return in form GSTR-10.

NIRC of ICAI has represented The President ICAI for Considering of the creation of a special Covid -19 Assistance corpus need  for CA members legal heir

We appreciate the current benefit approved by ICAI for its members suffering from Covid19. However, one would agree that there are number of untimely and unexpected deaths of our members are happening because of Covid19.
The above scenario requires onetime support in addition to the other support extended by the ICAI.
1. Thus we propose as under; to request The President of ICAI for Creation of a Special Covid- 19 Assistance Corpus for members of the Institute, by granting one-time financial assistance* to their legal heir of deceased Member(s) who have lost their life, between 1st April, 2020 to 31st March, 2022, due to Covid-19. As per the guidelines to be issued by ICAI, the Financial Assistance will be as under: 
Category of Members                                  Eligible Amount (in Rupees) 
Members less than 60 yrs.                    Rs.10,00,000/- (Rupees Ten Lakhs only).
Members who are 60 years and above Rs.2,00,000/- (Rupees Two Lakhs only),

We would also like to bring to your kind attention that ICSI has also extended the support to its members on the similar lines.

2. Consider requesting The President ICAI to Create a Covid Task Force at a Central level for facilitating the Vaccine Drive to all CA members above  18 years of age  and their immediate family by having a  MOU with the health ministry for the same. Similar facilities have been provided by Bar Council to their members has already started the same facility. *This is very urgent and needs to be finalized on war footing.

⚫Amid a raging second wave of COVID-19 and restrictions on business activities imposed by several states, economic recovery is beginning to loose steam and the country's GDP growth is likely to be below 9% for the current fiscal.

ANNOUNCEMENT

Mandatory updation of UDINs in all Income Tax Forms at e-filing Portal

Members are aware that the CBDT vide its press release dated 26th November 2020 has mandated the validation of the Unique Document Identification Number (UDIN) generated from ICAI portal in all the Income Tax Form and Audit Reports uploaded at the e-filing portal.

We have been given to understand that CBDT is in process of mandating the updation of UDINs for all IT Forms prior to its upload on the e-filing portal by the members. In other words, members would be required to first generate UDIN and provide the same while uploading the IT forms.

Further, CBDT has given the extension for updating UDINs for all the IT forms at the e-filing portal till 30th June, 2021. 

In view of the above, the members are requested to avail this opportunity and update the UDINs on the e-filing Portal at the earliest but not later than 30th June, 2021 to avoid likely invalidation.
