GST Council Meeting Updates

1️⃣ For all those who have no tax liability but have not filed GST returns for tax period July 2017 - Jan 2020 (prior to #COVID19 period), there shall be no late fee at all.

2️⃣ For people who have tax liability, maximum late fee for non-filing of GSTR-3B returns for period Jul 2017 - Jan 2020 has been capped to ₹ 500 instead of Rs 10,000. This will apply to all returns submitted during Jul 1, 2020 - Sep 30, 2020.

3️⃣ For small tax payers whose aggregate turnover is up to ₹ 5 crore, the rate of interest for late furnishing of GST returns for Feb, Mar and April 2020, beyond July 6, 2020: the rate of interest is being reduced from 18% to 9% till September.

4️⃣ Small tax payers whose aggregate turnover is up to ₹ 5 crore will be provided a waiver of late fees and interest if they file the form GSTR-3B for the supplies affected in months of May, June and July 2020, by September 2020.

5️⃣ Tax payers who could not get cancelled GST registrations restored in time are being given an opportunity to apply for revocation of cancellation of registration up to September 30, 2020. In all cases where registration has been cancelled till June 12, 2020.

Income Tax S. 68 Bogus Cash Credits: In the case of an assessee engaged in providing 'accommodation entries', the entire deposits cannot be assessed as unexplained cash credits. Only the commission (0.15%) earned in providing the accommodation entries can be assessed as income (PCIT vs. NRA Iron and Steel (2019) 103 Taxmann.com 48 (SC) distinguished) 

Goods and Services Tax Council decided to further ease compliance burden of businesses by providing relief on late free and interest payable on late payments. It reduced late fee and interest for those with tax liabilities and waived off late fee completely for those with no tax liabilities.

High Court of Kerala gave an judgment regarding GST Authorities to re-open portal for acceptance of a rectified GST TRAN-1. filling of the Form GST TRAN-1 electronically or accept manually in case of South Indian Bank Ltd. V. Union of India [2020] 113 taxmann.com 306 (Kerala) 

All India Forum of Real Estate Regulatory Authorities (AIFORERA) is planning to approach the Reserve Bank of India (RBI) to request for an one-time loan restructuring for the real estate sector, taking a cue from a similar aid extended to the micro, small and medium enterprises segment by the central bank.

IDBI Bank invites online applications from practicing partnership firms of Chartered Accountants within India, in the prescribed format, who are willing to have their firms empanelled as Concurrent Auditors of the Bank.

The students (who have already submitted online examination application for May 2020 
Examination cycle) shall be allowed to OPT-OUT and carry forward their candidature to next 
examination i.e. November, 2020 examination cycle. In this case, the examination fees and 
exemption, if any, of the particular student will automatically be shifted and carried forward to next 
examination i.e. November 2020 cycle and this attempt (May 2020) will be treated as cancelled / not 
counted. The student will be required to apply afresh for November 2020 Examination cycle at the relevant 
time. His / Her Examination fees will be adjusted and differential fees, if any, will only be charged (In case 
he/she has filled the form for May 2020 exams for one group only and in November 2020 exams cycle, 
he/she opts to appear in both groups, then, he/she will be required to pay the differential fees).

Exams commencing 29th July have an option to opt out and automatically shift ot November 2020.

Procedure for availing OPT–OUT facility

(Wednesday) 11 AM Onwards to 20th June 2020 (Saturday) 11.59 PM.

IMPORTANT ANNOUNCEMENT

During last few days, we have received mixed expression of opinions, views and requests from students, both relating to holding exams as per the schedule issued by The Institute of Chartered Accountants of India commencing from 29th July, 2020 or not holding exams in the prevailing COVID-19 pandemic situation.

Some students expressed concerns and anxiety on likelihood of spurt in COVID-19, availability of examination centre, students/centre in containment zone, social distancing and sanitization, availability of transport and accommodation facilities, loss of examination fee already paid and carry forward of exemption in case the student is not able to appear in the July 2020 examination. However, large number of students showed their strong desire to appear in examination as per the announced schedule.

ICAI is committed to serve even if one student wish to appear in examination scheduled from 29th July 2020, still considering the prevailing COVID-19 situation and in the interest of mitigating the anxiety and hardships of students, it has been decided to provide an OPT-OUT option to students.

The students (who have already submitted online examination application for May 2020 Examination cycle) shall be allowed to OPT-OUT and carry forward their candidature to next examination i.e. November, 2020 examination cycle. In this case, the examination fees and exemption, if any, of the particular student will automatically be shifted and carried forward to next examination i.e. November 2020 cycle and this attempt (May 2020) will be treated as cancelled / not counted. The student will be required to apply afresh for November 2020 Examination cycle at the relevant time. Remaining students who will choose not to opt out and wish to appear for the exams commencing from 29th July 2020, the Institute is making all the required and necessary arrangements for smooth conduct of May 2020 examination (commencing from 29th July, 2020) across the globe including strict adherence to the precautions / measures related to COVID–19 which cover thermal scanning, hands’ sanitization, wearing of masks, maintaining social distancing at all times, following Government guidelines, etc. for the examinees / centre functionaries during the conduct of Chartered Accountant Examination.

However, situation of pandemic will be reviewed (COVID cases, MHA guidelines, Centre and State Government directions) in first week of July 2020 and status will be intimated to students who have not opted out. Further, conduct of examinations commencing from 29th July 2020 will be strictly dependent upon the then Government’s advisories which may be issued for the area in which a particular Centre is situated and in any such eventuality, the students will be accommodated to the November 2020 examination cycle.

Furthermore, for Students seeking change of examination centre for the exams commencing from 29th July, 2020, the online facility for seeking change of examination centre (for the students who have already submitted online examination application for May 2020 Examination cycle) will be available at http://icaiexam.icai.org from 17th June 2020 (Wednesday) 11 AM Onwards to 20th June 2020 (Saturday) 11.59 PM.

Intermediate (Integrated Professional Course) [IPCE-Old Course] will be extended for one more attempt i.e. November 2020 Examination cycle.

Income Tax Corporate advance tax collections were down 79% on year in the period while advance payments of personal income tax were lower by 65%. The total collections of advance taxes, a mechanism used by the large individual and corporate taxpayers, were just Rs 11,714 crore till the June 15 deadline, less than a quarter of Rs 48,917 crore collected in the year-ago period.

GST For turnover upto 5cr, no late fee or interest for GSTR-3B of Feb, Mar & Apr 2020 filed till specifies dates. Till 30 Sep, interest @9% from original due date.

GST For turnover upto 5cr, no late fee or interest for GSTR-3B of May, Jun & Jul 2020 filed till staggered due dates upto 30 Sep. After that, Interest @18%.

RBI has relaxed the deployment norms of automated teller machines (ATMs) by white-label players, who will now not need to put up thousands of units every year. This is way off the 1,000-25,000 ATMs that would have been added annually by each operator based on the schemes they had opted for. Industry sources say as many as 200,000 WLATMs would have been deployed if the run rate had been maintained.

Supreme Court issued notice in a plea challenging the constitutional validity of Sections 3 and 10 of the Insolvency and Bankruptcy Code (Amendment) Act, 2020 [Association of Karvy Investors v. Union of India]. The three-judge Bench issued notice to the Centre and also extended protection to all such petitions filed under Section 7 of the IBC Amendment Act that do not meet the 10% requirement as introduced by the amendment.

FSSAI: Food Safety and Standards Authority of India has decided to extend the date for a mandatory food safety audit of food businesses under the FSS (Food Safety Auditing) Regulations 2018. FSSAI, in order, has stated that the food businesses holding Central licences and falling under high risk category can now complete the mandatory audit by Sept 30, 2020.

ICAI Organisation of Virtual CPE Meeting for grant of Structured CPE hours and extension of last date for online submission of self-declaration form for claiming unstructured CPE hours for calendar year 2019 till 30th June, 2020.

ICAI A provision for generating UDIN in bulk for Certificates has been incorporated in UDIN Portal. Using this facility now the members will be able to generate UDIN in bulk (uptil 300 UDINs) for various types of Certificates in one go. It can be done through uploading of excel file.

Schedule-III of GST states that transactions where “supply of goods from a place in the non-taxable territory to another place in the non-taxable territory without such goods entering into India” shall be treated neither as supply of goods or services and hence not liable to GST.

However an Advance Ruling was made which created many Q among Taxpayers. 

The ruling by the Gujarat-Bench of the AAR states that GST will be levied on Merchant Trade Transactions.

A domestic company buying goods from abroad and selling to another country will have to pay GST on such transactions even if the said products are not entering the Indian territory, the Authority for advance ruling (AAR) has said.

On an application filed by Sterlite Technologies, the Gujarat-Bench of AAR has ruled that GST is payable on goods sold to customer located outside India, where goods are shipped directly from the vendor’s premises (located outside India) to the customer’s premises.

The applicant had sought to know whether the goods and services tax (GST) would be levied on merchant trade transactions (MTT).

“It appears that the transaction is covered under the ambit of inter-State supply and is neither exempted nor covered under export of services. Thus, the theory of elimination takes us to the conclusion that such supplies will be subject to levy of IGST (integrated GST),” the AAR has ruled.

The AAR verdict means that GST would be levied on MTT where applicant will receive an order from the customer located outside India and as per their instruction, the vendor would directly ship the goods to customer located outside India.

Vendor would issue invoice on applicant against which payment would be made in foreign currency and applicant would raise invoice on customer and would receive consideration in foreign currency.

In the above transaction, goods would not physically come into India, but would move from place outside India to another place outside India.

In my opinion this will create huge liability on Indian suppliers as the burden of such tax are usually decided to be borne by Indian suppliers by the foreigners.

Also if they do not transfer to Indian suppliers it will increase the cost of products of India and ultimately reduce the export from country.

Income Tax -New disclosures asked in the New ITR forms 1 to 7 are: 

House ownership: Individual taxpayers who are joint owners of house property cannot file ITR-1 or ITR-4.

Passport: One needs to disclose the Passport number if held by the taxpayer. This is to be furnished both in ITR 1-Sahaj and ITR 4-Sugam. Hopefully, it will be made mandatory in other ITR Forms as and when they are notified.

Cash deposit: For those filing ITR 4-Sugam, it has been made compulsory to declare the amount deposited as cash in a bank account, if such amount exceeds Rs 1 crore during the FY.

 Foreign travel: If you have spent more than Rs 2 lakh on traveling abroad during the FY, you need to disclose the actual amount spent.

Electricity consumption: If your electricity bills have been more than Rs 1 lakh in aggregate during the FY, you need to disclose the actual amount.

 Investment details:  Details of investment qualifying for deduction under chapter VIA with bifurcation of details of investment made during the period from April 1, 2020 to June 30, 2020.

 Extension - For every assessment year, the last date for filing tax returns is July 31, However, this year ITR filing date has been extended till November 30, 2020 due to pandemic Covid-19. 

 Income Tax Exemptions and Deductions that you can claim under the New Tax Regime for FY 2020-21 (AY 2021-22): Withdrawal by an employee from the Employees' Provident Fund (EPF) is not taxable after 5 years of continuous service.

Withdrawal from National Pension Scheme (NPS) on maturity or premature closure up to 40% of the amount received on such withdrawal remains tax free for all. In case of partial withdrawal from NPS, up to 25% of the contributions made by the individual will be tax free. Employer’s contribution to NPS up to 10% of their basic salary and dearness allowance also remains tax free.

Under Section 10 (10D) of the Income Tax Act, the sum assured and any bonus paid on maturity or surrender of the life insurance plan is tax free. Maturity proceeds continue to be exempt under Section 10(10D) even in the new regime. The maturity amount including interest received on the Sukanya Samriddhi Yojana will not attract any tax.

 Conveyance Allowance granted to meet expenditure incurred on conveyance in performance of duties of an office and any allowance granted to an employee to meet the cost of travel on tour or on transfer (including relocation) are tax free. Interest received from post office savings account balance up to ₹3,500 annually per individual will remain free from tax.

Any scholarship granted to meet education costs is tax exempt under Section 10 (16) of the Income Tax Act. Gratuity received from the employer up to ₹20 lakh after rendering 5 years of continuous service. Leave encashment received at the time of resignation or retirement up to ₹3 lakh.

Form 26AS will now be a complete profile of the taxpayer w.e.f. 01.06.2020, CBDT vide Notification dated May 28, 2020 amended Form 26AS in Sec 285BB w.e.f. 01.06.2020. Key takeaways are:

New form 26AS will also provide information in respect of “Specified financial transactions” which include transactions of purchase/ sale of goods, property, services, works contract, investment, expenditure, taking or accepting any loan or deposits of such value as may be prescribed but not less than of Rs 50,000.

 Information about income tax demand, refund, proceedings pending, and proceedings completed which may include assessment, reassessment under section 148,153A 153C, revision, appeal will also be shared in this form 26AS.

Information on this form 26AS will not be a one-time affair at year end. This will be a live 26AS, as this will be updated regularly within 3 months from the end of the month in which such information is received.  

Form 26AS will now be a complete profile of the taxpayer for that particular year as against earlier form 26AS which just provided the information about taxes paid by way of TDS/TCS or self-assessing. This form will also have mobile no, email I’d and Aadhar no. of the taxpayer.  

Further an enabling provision has been notified empowering the CBDT to authorise DG Systems or any other officer to upload in this form, information received from any other officer, authority under any law. Thus any adverse action initiated or taken or found or order passed under any other law such as custom , GST , Benami Law etc. including information about Turnover, import, export etc. will also be put in this form 26AS so that not only the concerned taxpayer but  also all the Income Tax authorities will  know and have access to such information.    

This form 26AS will also provide information received by Tax Deptt from any other country under the treaty /exchange of information about income or assets of the taxpayer located outside India.  

The implication of this new form 26AS will be that banks , financial institutions or any other authority or customer , buyer etc. while carrying out due diligence of the person/ corporate concerned will now ask for form 26AS  so as to be sure that there are not any major issues about such person/corporate.  

This will now make difficult for any taxpayer to hide information from any bank / financial institution/ authority about any proceedings against under any law or tax demand, tax disputes etc.

FM Smt. Nirmala Sitharaman announces 1st decision of 40th @GST_Council meeting

1⃣ For all those who have no tax liability but have not filed GST returns for tax period July 2017 - Jan 2020 (prior to #COVID19 period), there shall be no late fee at all

2️⃣ For people who have tax liabiity, maximum late fee for non-filing of GSTR-3B returns for period Jul 2017 - Jan 2020 has been capped to ₹ 500

This will apply to all returns submitted during Jul 1, 2020 - Sep 30, 2020

3️⃣For small tax payers whose aggregate turnover is up to ₹ 5 crore, the rate of interest for late furnishing of GST returns for Feb, Mar and April 2020, beyond July 6, 2020: the rate of interest is being reduced from 18% to 9% if filed before 30th Sept 2020

4️⃣ Small tax payers whose aggregate turnover is up to ₹ 5 crore will be provided a waiver of late fees and interest if they file the form GSTR-3B for the supplies affected in months of May, June and July 2020, by September 2020, no late fee or interest

5️⃣ Tax payers who could not get cancelled GST registrations restored in time are being given an opportunity to apply for revocation of cancellation of registration up to September 30, 2020 - In all cases where registration has been cancelled till June 12, 2020

Whether Bad Debts qualify FOR reduction in output tax under GST?

The term bad debts usually refers to accounts receivable (or trade accounts receivable) that will not be collected. This could be due to non recovery of money receivable from trade debtors.

Under Income Tax Act, this amount is treated as expense of the year in which it is crystallized that amount is irrecoverable.

As per Sec. 36(2) of the Income Tax Act, 1961, this deduction while computing income of the assessee for the previous year shall be allowed. Provided that amount of debt has been taken into account for computing income of the assessee. 

Under GST, as per Sec. 34 of the CGST Act, for following reasons, supplier shall be allowed to reduce its output tax liability by way of issuing credit note

Sec 34-Issuance of Credit Notes

Where one or more tax invoices have been issued for supply of any goods or services or both and 

1. the taxable value or tax charged in that tax invoice is found to exceed the taxable value or tax payable in respect of such supply, or 

2. where the goods supplied are returned by the recipient, or 

3. where goods or services or both supplied are found to be deficient, 

the registered person, who has supplied such goods or services or both, may issue to the recipient one or more credit notes for supplies made in a financial year containing such particulars as may be prescribed.

For any reason other than mentioned above, reduction in output tax liability is not permitted.

Now, pertinent question here is, whether due to bad debts, amount which is not recovered by the supplier for supply of goods or services made, output tax shall be allowed to be reversed to the supplier?

Event of bad debts is not anything which is mentioned u/s 34 of the Act, it is neither deficient supply of goods or services or goods returned nor taxable value or tax payable changes. Considering all these in mind, one can safely deduce from the existing provisions of the CGST Act, that no benefit of output tax reduction is available in the event of bad debts. This creates an imbalanced and unjust situation for the supplier, on the one hand he could not collect the consideration for the supply of goods or services on the other he is required to pay  GST from his own pocket.

Author understands that the similar position was existent in the eartwhile regime of service tax also, but it is highly required to reconsider this position by the law makers now. Author strongly urges the GST Council to take cognizance of the plight of the supplier specially during this economic turmoil caused due this pandemic.

CBDT said The gross direct tax collection (without deducting refunds) was Rs 12.34 lakh crore in FY20, lower than Rs 12.98 lakh crore in FY19. The growth in direct tax collection for FY 2019-20 has fallen drastically, the government said that the fall in the collection of direct taxes is on expected lines and these reports are not true.

CBIC said in a circular that the customs department will on 8/6/2020 roll out the first phase of the country-wide faceless assessmemt of consignments. Under the system, consignments will be assessed by officials electronically, irrespective of the port where the goods arrive. The first phase will commence in Chennai and Bengaluru. It will cover a specific set of items and will be expanded across India by this calendar year-end.

Delhi High Court gave an important judgment that the GST authorities to permit applicant to file rectified Form GST TRAN-1 either electronically or manually in case of SRC Aviation (P.) Ltd. V. Union of India [2020] 113 taxmann.com 435 (Delhi)

UP-RERA has allowed homebuyers association to take over and complete the project. The authority had revoked the registration of the project Sampada Livia after the developer failed to complete it and diverted money collected from homebuyers. While 24 homebuyers moved RERA, an audit by a consultant appointed by Greater Noida Industrial Development Authority revealed diversion of R 47 crore.

Reserve Bank of India (RBI) said the price discovery process may be deregulated during sale of bad loans by financial institutions such as banks, non-bank lenders and housing finance companies (HFCs).  

Sebi eased the compliance norms for companies seeking to list their debt securities such as non-convertible debentures (NCDs) and commercial papers. This will come into force with immediate effect, the Securities and Exchange Board of India (Sebi) said in a circular.

Clarification in respect of levy of GST on Director’s Remuneration

Circular No: 140/10/2020 - GST dated 10.06.2020

It is clarified that the part of Director's remuneration which are declared as "Salaries‟ in the books of a company and subjected to TDS under Section 192 of the IT Act, are not subject to GST and not treated as supply in terms of Schedule III of the CGST Act, 2017.

It is further clarified that the part of Director's remuneration which is declared separately other than "salaries" in the Company's accounts and subjected to TDS under Section 194J of the IT Act as Fees for professional or Technical Services shall be treated as taxable supply for GST and company is liable to discharge the applicable GST on it on RCM basis.

CBDT has notified the income-tax return forms for the financial year ended March 31, 2020 (assessment year 2020-21). The I-T return forms (ITR-1 to ITR-7) incorporate the recent announcement made by the finance minister to ease the burden on taxpayers owing to the Covid-19 pandemic.

AAR gave an important ruling that  AAR cannot decide on surrender of GST registration regarding validity of question asked to the Authority in case of Maneckji Cooper Education Trust [2019] 112 taxmann.com 290 (AAR- MAHARASHTRA)

ICAI will develop a framework for audit quality indicators that will also help Indian audit firms and auditors to compete globally. ICAI said that currently quality of audit is not being benchmarked, and the focus is to have customised audit quality indicators. The ICAI has also decided to open a Centre for Audit Quality at Jaipur.

GSTN said it has enabled new registration functionality on the GST portal for erstwhile registered entities who are now corporate debtors under the provisions of the Insolvency and Bankruptcy Code (IBC). This facility will benefit the companies that are undergoing the corporate insolvency resolution process and whose management affairs are being undertaken by IRPs or RPs. 

Sebi has extended to August 1, 2020 the date for implementing norms pertaining to power of attorney given by clients to trading members or clearing members. The regulator had in February 2020 specified guidelines with regard to margin obligations to be given by way of pledge and re-pledge in the depository system. The provisions of the circular were to come into effect from June 1, 2020.

Question no 1 on Treatment of Intangibles in GST

Whether Intangibles such as trademarks and copyrights would considerd to be goods?

Answer
Sec 2(52) Of CSGT ACT, Defines Goods as goods means every kind of movable property other than money and securities.

Sec 2(102) Defines Services, Services means anything other than goods, money and securities.

Analysis
Every kind of movable property is goods barring exclusions. But the term movable property is not defined in CGST Act so we can take inference from General Clauses Act 1897. As per Sec 3(36) of this Act, moveable property is defined as "property of every description except immovable property" 

So, it's amply clear from this above discussion that intangibles such as trademarks and copyrights shall well come in the definition of movable property therefore it shall be categorised as "GOODS"

Income tax department has released the ITR-1 utility (e-form) on its e-filing website. The ITR-1 form is available in Excel and Java formats. One point to note about the latest ITR-1 form is that it allows individuals to claim the deductions on tax-saving investments made between April 1, 2020 and June 30, 2020 under the DI Schedule.

Income Tax New disclosures asked in the new ITR forms 1to7 are: 1. House ownership: Individual taxpayers who are joint owners of house property cannot file ITR 1 or ITR4.

Passport: One needs to disclose the Passport number if held by the taxpayer. This is to be furnished both in ITR 1-Sahaj and ITR 4-Sugam. Hopefully, it will be made mandatory in other ITR Forms as and when they are notified.

Cash deposit: For those filing ITR 4-Sugam, it has been made compulsory to declare the amount deposited as cash in a bank account, if such amount exceeds Rs 1 crore during the FY.

Foreign travel: If you have spent more than Rs 2 lakh on travelling abroad during the FY, you need to disclose the actual amount spent.

Electricity consumption: If your electricity bills have been more than Rs 1 lakh in aggregate during the FY, you need to disclose the actual amount.

Investment details:  Details of investment qualifying for deduction under chapter VIA with bifurcation of details of investment made during the period from April 1, 2020 to June 30, 2020.

For every assessment year, the last date for filing tax returns is July 31, However, this year ITR filing date has been extended till November 30, 2020 due to pandemic Covid-19. 

Income Tax Exemptions and Deductions that you can claim under the New Tax Regime for FY 2020-21 (AY 2021-22): Withdrawal by an employee from the Employees' Provident Fund (EPF) is not taxable after 5 years of continuous service.

Withdrawal from National Pension Scheme (NPS) on maturity or premature closure up to 40% of the amount received on such withdrawal remains tax free for all. In case of partial withdrawal from NPS, up to 25% of the contributions made by the individual will be tax free. Employer’s contribution to NPS up to 10% of their basic salary and dearness allowance also remains tax free.

Under Section 10 (10D) of the Income Tax Act, the sum assured and any bonus paid on maturity or surrender of the life insurance plan is tax free. Maturity proceeds continue to be exempt under Section 10(10D) even in the new regime. The maturity amount including interest received on the Sukanya Samriddhi Yojana will not attract any tax.

Conveyance Allowance granted to meet expenditure incurred on conveyance in performance of duties of an office and any allowance granted to an employee to meet the cost of travel on tour or on transfer (including relocation) are tax free. Interest received from post office savings account balance up to ₹3,500 annually per individual will remain free from tax.

Any scholarship granted to meet education costs is tax exempt under Section 10 (16) of the Income Tax Act. Gratuity received from the employer up to ₹20 lakh after rendering 5 years of continuous service. Leave encashment received at the time of resignation or retirement up to ₹3 lakh.

Form 26AS will now be a complete profile of the taxpayer w.e.f. 01.06.2020, CBDT vide Notification dated May 28, 2020 amended Form 26AS in Sec 285BB w.e.f. 01.06.2020. Key takeaways are:

New form 26AS will also provide information in respect of “Specified financial transactions” which include transactions of purchase/ sale of goods, property, services, works contract, investment, expenditure, taking or accepting any loan or deposits of such value as may be prescribed but not less than of Rs 50,000.     

Information about income tax demand, refund, proceedings pending, and proceedings completed which may include assessment, reassessment under section 148,153A 153C, revision, appeal will also be shared in this form 26AS.      

Information on this form 26AS will not be a one-time affair at year end. This will be a live 26AS, as this will be updated regularly within 3 months from the end of the month in which such information is received.       

Form 26AS will now be a complete profile of the taxpayer for that particular year as against earlier form 26AS which just provided the information about taxes paid by way of TDS/TCS or self-assessing. This form will also have mobile no, email I’d and Aadhar no. of the taxpayer.      

Further an enabling provision has been notified empowering the CBDT to authorise DG Systems or any other officer to upload in this form, information received from any other officer, authority under any law. Thus any adverse action initiated or taken or found or order passed under any other law such as custom , GST , Benami Law etc. including information about Turnover , import , export etc. will also be put in this form 26AS so that not only the concerned taxpayer but  also all the Income Tax authorities will  know and have access to such information.      

This form 26AS will also provide information received by Tax Deptt from any other country under the treaty /exchange of information about income or assets of the taxpayer located outside India.     

The implication of this new form 26AS will be that banks , financial institutions or any other authority or customer , buyer etc. while carrying out due diligence of the person/ corporate concerned will now ask for form 26AS  so as to be sure that there are not any major issues about such person/corporates.   

This will now make difficult for any taxpayer to hide information from any bank / financial institution/ authority about any proceedings against under any law or tax demand, tax disputes etc.

Income Tax Department has notified forms for filing income tax returns with few changes. These forms include Sahaj (ITR-1), Form ITR-2, Form ITR-3, Form Sugam (ITR-4), Form ITR-5, Form ITR-6 and Form ITR-7. ITR forms can be used by taxpayers to file their income tax return online.

Revised Form 26AS to contain details of specified financial transactions like those in property, shares etc. also. IT rule 114-l wef 1.6.2020.

FM SITHARAMAN LAUNCHES SCHEME FOR INSTANT ALLOTMENT OF ONLINE PAN 

Finance Minister Nirmala Sitharaman on Thursday launched a facility for instant allotment of online PAN on furnishing Aadhaar details.

The Budget 2020-21 had proposed to launch a system under which Permanent Account Number (PAN) shall be instantly allotted online on the basis of Aadhaar without filling up the detailed application form as it sought to further ease the process of PAN allotment.

In a statement, the Central Board of Direct Taxes (CBDT) said Finance Minister Nirmala Sitharaman on Thursday formally launched the facility.

The 'beta version' for instant allotment of PAN on trial basis was started on February 12, 2020 on the e-filing website of the Income-Tax Department. Since then, 6,77,680 instant PANs have been allotted with a turnaround time of about 10 minutes, till May 25, 2020.

CBDT assigned jurisdiction to officers from its international tax division over assessees coming under the purview of ‘equalisation levy’ on e-commerce companies. Experts said the CBDT’s move is a sign that the government is moving ahead with the levy, which came into force on April 1, despite several representations from industry bodies on behalf of foreign companies calling for deferment of the tax due to the fear that the wide-ranging scope of the law may end up taxing even non-digital transactions, leading to possible double taxation.

Union Cabinet has cleared the proposal to suspend Insolvency and Bankruptcy Code (IBC) proceedings for bank defaulters for six months with a provision to extend the period for up to one year. 

Cabinet cleared an ordinance to amend the Insolvency and Bankruptcy Code (IBC) whereby fresh insolvency proceedings will not be initiated for defaults due to the COVID-19 pandemic.

🖋 ITR 1 - For individuals being a resident (other than not ordinarily resident) having total income up to Rs.50 lakh, having Income from Salaries, one house property, other sources (Interest, etc.), and agricultural income up to Rs.5 thousand and Not for an individual who is either Director in a company or has invested in unlisted equity shares.

🖋 ITR – 4 - For individuals, HUFs and Firms (other than LLP) being a resident having total income up to Rs.50 lakh and having income from business and profession which is computed under section 44AD, 44ADA or 44AE.

Individual who is either Director in a company or has invested in Unlisted Equity Shares are not eligible to file ITR 4.

Details Keytakeways in ITR 4 are as follows

1. A taxpayer who has a brought forward/carry forward loss from ‘Income from house property’ cannot use ITR-4 to file his income tax return for FY 2019-20 onwards.

2. In case the house property is rented out, the taxpayer will have to provide the name and PAN or Aadhaar of the tenant in the ITR-4.

3. A new disclosure has been added to Part A- General Information of ITR-1. Here, a taxpayer will have to disclose whether he/she has a valid Indian passport. If yes, he/she will have to provide the passport number.

4. The additional details required by the income tax department from the taxpayers using ITR-4 in FY 2019-20 are as follows:
• Has the taxpayer deposited an amount or aggregate of amounts exceeding Rs 1 crore in one or more current account during the previous year? If yes, the amount has to be reported.
• Has the taxpayer spent an amount or aggregate of the amount exceeding Rs 2 lakh for travel to a foreign country for himself/herself or for any other person? If yes, the amount has to be reported.
• Has the taxpayer incurred an expenditure exceeding Rs 1 lakh on the consumption of electricity during the previous year? If yes, the amount has to be reported.

5. In case ITR-4 is being filed by a representative, Aadhaar number of the representative is required to be provided in ITR-4 from FY 2019-20 onwards.

6. The taxpayers using ITR-4 will also have to disclose the following additional details in Part A- General information:
• Whether the taxpayer is a partner of a firm? If yes, he will have to furnish the name and PAN of the firm.
• Details of partners of the firm such as name, address, percentage of share in the firm, PAN, aadhaar number, rate of interest on capital and remuneration paid/payable.

7. The ‘Nature of Employment’ has been moved from the Part A- General Information to B1 of Part B- Salary Schedule of ITR-4.

8. The ‘Financial particulars of the business’ section of the ITR-4 has been replaced by “Particulars of cash and bank transactions relating to presumptive business”. Under this tab, the taxpayer will have to enter the opening balance of cash and bank (aggregate of all bank accounts), receipts during the year, and payments or withdrawals made in the previous year.

9. A separate column has been introduced under ‘Income from other sources’ for deduction u/s 57(iv) – in case of interest received on compensation or enhanced compensation under section 56(2)(viii).
