CBDT directed Taxmann to check whether Service charge collected by hotels and restaurants but not passed on to staff and workers will be liable to income tax in the hands of such entities, the tax department has said.

SEBI proposed Corporates, NBFCs and other businesses may soon have to disclose key information for issuing commercial papers (CPs) — an unsecured, convenient instrument to borrow short-term fund — to mutual funds (MFs).

RBI in its central board meeting decided the issue of banks under PCA will be examined by Board for Financial Supervision of the central bank. The finance ministry hopes that 3-4 banks would come out of the RBI's Prompt Corrective Action watchlist this fiscal, following the expected modification of guidelines and apparent improvement in bottomline of the public sector banks.

Withdrawal of the Implementation Guide on Auditor's Report under Rule 11(d) of Companies (Audit and Auditors) Amendment Rules, 2017 and Amendment to Schedule III to Companies Act, 2013 I. AASB of ICAI at its 190th meeting held on 1st & 2nd November 2018 decided to withdraw the aforesaid Implementation Guide.

The payroll data has been revised downwards for each of the nine months between September 2017 and May this year The net enrolment numbers released by the EPFO has been revised down by 12.4 per cent for the September-May period, from an earlier estimate of 4.5 million to 3.9 million.

COMPANIES ACT LEGAL UPDATES

1. NCLAT dismissed appeal filed u/s 421 of the Companies Act, 2013 by the aggrevied director to get re-appointed in the Company after completing his tenure. It held that the retirement of the director and re-election or not to re-elect the director is the normal routine in the company matters. If a person is not re-elected after he has retired as per Companies Act provisions/ AOA of the Company, No grievance of his re-election can be raised by such person.

6. IT: Reopening of assessment u/s 147 - deduction u/s. 801A/IB - reassessment framed by the AO is bad in law for the three reasons – Bharat Petroleum Corp. Ltd., Vs ACIT (2018 (11) TMI 1237 - ITAT Mumbai).

Indirect Tax Legal updates:

1. Service Tax- Mobilization advance- The amount received by the appellant from Indian Navy for building facilities is in the nature of a grant and to be amortized against future payments. No service tax is payable on the amount received towards mobilization advance of the contract from the Indian Navy.

Central Excise- Refund claim of excess duty paid- The value that was agreed upon between the buyer and the seller at the time of clearance, determines the assessable value and both of them intended alteration  of the specification of the product. Accordingly, the discharge of duty liability in excess is held to have been established. This amount is eligible to be refunded in consequence of refund claim.
