ADVISORY FOR WAIVER SCHEME UNDER SECTION 128A

1. Waiver Scope: Interest and penalties waived for demand notices/orders under Section 73 of the CGST Act, 2017 (no fraud, suppression, or wilful misstatement involved) for FY 2017-18, 2018-19, and 2019-20.

2. Deadline for Tax Payment:Tax must be fully paid by March 31, 2025, to avail of the waiver benefits.

3. New Rule Notification: Rule 164 of CGST Rules, 2017, was notified via Notification No. 20/2024 dated October 8, 2024, effective from November 1, 2024, detailing procedural guidelines for the waiver scheme.

4. Forms Required:Taxpayers must file an application in Form GST SPL-01 or Form GST SPL-02 on the common portal within three months from the notified date (deadline March 31, 2025).

5. Availability of Forms: Forms GST SPL-01 and GST SPL-02 will be available on the portal in January 2025.

6. Payment Instructions:

Demand Orders: Pay via the “payment towards demand” facility.

Notices: Pay using Form GST DRC-03.

Linking Previous Payments: If tax has already been paid through DRC-03, link it to the demand order using Form GST DRC-03A (now available on the portal).

7. Advised Action:Taxpayers should ensure tax payment by March 31, 2025, to qualify for the waiver benefit.
